1. Acceptance of Terms

By accessing or using the ExtendedBrain.ai SaaS portal ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

ExtendedBrain.ai provides a cloud-based software-as-a-service platform that enables users to access advanced AI-powered tools and services. The Service includes any updates, enhancements, modifications, or new features added to the platform.

 

3. User Accounts

3.1. You must register for an account to access the Service. You agree to provide accurate, current, and complete information during registration.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. You must immediately notify ExtendedBrain.ai of any unauthorized use of your account or other security breaches.

4. Subscription, Payment Terms, and Trial License

4.1. Access to the Service requires a paid subscription or an active trial license. Current pricing is available on our website.

4.2. Subscriptions are billed in advance on a monthly or annual basis.

4.3. All payments are non-refundable except where required by law.

4.4. We reserve the right to modify pricing with 30 days' notice.

4.5. Trial License Terms:

• Trial licenses are provided at our discretion

• We reserve the right to terminate any trial license at any time without prior notice

• Trial periods and features may be limited

• Upon trial expiration, access to the Service will be suspended until a paid subscription is activated

• Data entered during the trial period may be retained or deleted at our discretion unless a paid subscription is activated

5. User Data and Privacy

5.2. You retain all rights to any data you upload to the Service.

5.3. We will not access your data except as necessary to provide and maintain the Service or as required by law.

6. Acceptable Use

6.1. You agree not to:

• Attempt to gain unauthorized access to the Service

• Interfere with other users' access to the Service

• Reverse engineer the Service

6.2. Violation of these acceptable use terms may result in immediate termination of your account.

7.1. We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service.

7.2. Scheduled maintenance will be announced at least 48 hours in advance.

7.3. Technical support is available via email during business hours.

8. AI Technology and Limitations

8.1. ExtendedBrain.ai utilizes Generative AI and Large Language Models (LLMs) in providing the Service.

8.2. You acknowledge and agree that:

• AI-generated responses are non-deterministic and may produce different results for the same input

• The accuracy, completeness, and appropriateness of AI-generated content cannot be guaranteed

• All AI-generated responses must be carefully reviewed and verified before use

• ExtendedBrain.ai is not responsible for decisions made based on AI-generated content

• The Service may exhibit biases inherent in AI training data and algorithms

8.3. You are solely responsible for:

• Verifying the accuracy of any AI-generated content

• Ensuring AI-generated content is appropriate for your intended use

• Any consequences resulting from the use of AI-generated content

9. Medical and Professional Advice Disclaimer

9.1. The Service, including any narratives, responses, or content generated through our AI technology:

• Is not intended to provide medical, healthcare, or professional advice

• Should not be construed as medical, health, or professional guidance

• Is for informational purposes only

9.2. You agree to:

• Not rely on the Service for medical decisions or advice

• Not use AI-generated content in place of professional medical opinions

• Exercise appropriate caution when interpreting health-related information

9.3. Healthcare professionals using the Service agree to:

• Independently verify all AI-generated content

• Exercise professional judgment in all patient-related matters

• Not rely solely on the Service for clinical decision-making

• Maintain compliance with all applicable medical practice standards and regulations

10. Intellectual Property Rights

10.1. The Service and its original content, features, and functionality are owned by ExtendedBrain.ai and are protected by international copyright, trademark, and other intellectual property laws.

10.2. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

11. Limitation of Liability

11.1. ExtendedBrain.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11.2. Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

12.1. You may terminate your account at any time by following the instructions on the website.

12.2. We may terminate or suspend your account immediately for violations of these Terms.

12.3. Upon termination, you will have 30 days to export your data from the Service.

13. Changes to Terms

13.1. We reserve the right to modify these Terms at any time.

13.2. We will notify users of material changes via email at least 30 days before the changes take effect.

13.3. Continued use of the Service after changes constitute acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of Alabama, without regard to its conflict of law provisions.

These Terms constitute the entire agreement between you and ExtendedBrain.ai regarding the use of the Service, superseding any prior agreements between you and ExtendedBrain.ai.
